The Duty to Manage Asbestos
After any asbestos survey, our experienced asbestos surveyors will produce a comprehensive asbestos report. All commercial buildings and residential communal areas built before 2000 need require an asbestos register. This is a legal requirement under the Duty to Manage Asbestos 2012. The materials identified within the report should be monitored every 12 months as part of the Asbestos Management Plan.
The asbestos register within the asbestos report will detail all asbestos-containing materials (ACMs) found or presumed to be on the premises. It is essential that these items are monitored for damage, therefore the material can be removed or managed before it presents are risk to health and safety. This is the responsibility of the ‘duty holder’, this is typically the premises owner. However, can be the person or company who is responsible for maintenance and up-keep of the building.
This means that every 12 months:
- There is a regular inspection to check the condition of ACMs in a building
- If and when any ACMs have been removed, this information should be updated
- If any new areas have been surveyed and ACMs found, this should be added
- All ACMs should be monitored, and any deterioration or damage should be noted
The duty to manage asbestos covers all non-domestic properties, including (though not limited to) warehouses, factories, offices, shops, hospitals, schools, care homes, pubs, restaurants, hotels, healthcare premises, and leisure centres. It also covers all common parts of domestic buildings and blocks of flats, such as corridors, lift shafts and lifts, staircases, foyers, roof space, outhouses, and yard areas.
